This policy outlines how we collect, use, and protect the personal data of missing persons, their families, and our volunteers, in compliance with the General Data Protection Regulation (GDPR).

3. The Personal Data We Collect We process the following categories of personal data:

  • Data from Missing Persons: Full name, date of birth, physical description, recent photographs, last known location, medical history relevant to the disappearance, details of circumstances, copies of police reports, report reference numbers
  • Data from Family & Informants: Full name, relationship to the missing person, contact details (phone number, email address, physical address).
  • Data from Volunteers: Full name, contact details, training history, skills, and any other relevant information.
  • Website Usage Data: IP addresses, cookies, and other analytics data

4. Purposes and Legal Basis for Processing

Assisting in the Search for Missing Persons

  • Legal Basis: The processing of this data is based on the vital interests of the missing person and the legitimate interests of their family and the public. It is necessary to protect the life and physical integrity of the missing person, who cannot provide consent. It also fulfills our legitimate interest in achieving our humanitarian mission.

Communication with Families, Informants, and Law Enforcement

  • Legal Basis: We process data for communication based on our legitimate interest in coordinating search efforts. However, for non-essential communication or general updates, we will rely on your explicit consent.

Managing Our Volunteer Network

  • Legal Basis: We process volunteer data as it is necessary for the performance of the volunteer agreement, which allows us to manage roles, communicate tasks, and ensure safety. We may also rely on our legitimate interests for administrative tasks not covered by this agreement, such as training records.

Website Management and Improvement

  • Legal Basis: For strictly necessary cookies that ensure the website’s security and functionality, we rely on our legitimate interests. For all other cookies, such as those used for analytics or performance, we will obtain your explicit consent before placing them on your device.

5. How We Share Your Personal Data We may share your personal data with the following parties, only when necessary and for the purposes stated above:

  • Law enforcement agencies in Spain (e.g., Guardia Civil, Policia Nacional), other missing persons organisations (e.g., in other EU countries), and media outlets (with consent from the family).

6. Data Retention We will retain your personal data for no longer than is necessary for the purposes for which it was collected. Data relating to a missing person’s case will be retained until the person is found or for a maximum of 6 years after the case is closed. Volunteer data will be retained for 2 years after their last active period.

  • The right to access – You have the right to ask us for copies of your personal data.
  • The right to rectification – You have the right to ask us to correct information you believe is inaccurate. You also have the right to ask us to complete information you believe is incomplete.
  • The right to erasure – You have the right to ask us to erase your personal data in certain circumstances. We may not be able to fulfill your request if the data is necessary for our mission to find a missing person or for legal purposes.
  • The right to object to processing – You have the right to object to us processing your personal data. We will stop processing your data unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms.
  • The right to complain – You have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD).
